Overview
Welcome to The Bark Bakery!
These Terms and Conditions govern your access to and use of our website, online store, products and related services.
Throughout these Terms and Conditions, the terms “we”, “us” and “our” refer to The Bark Bakery.
Our online store is powered by Shopify, which provides the ecommerce platform that enables us to sell our products and services.
By accessing our website or placing an order, you agree to these Terms and Conditions and acknowledge our Privacy Policy.
Please read these Terms and Conditions carefully before using our website or purchasing our products.
Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded.
1. Access and Accounts
You agree to use our website lawfully and provide accurate, current and complete information when placing an order or creating an account.
If you create an account, you are responsible for maintaining the confidentiality of your login details and for activities undertaken through your account, except to the extent that responsibility cannot lawfully be imposed on you.
You must notify us promptly if you become aware of any unauthorised access to your account.
If you are under 18 years of age, you should obtain permission from a parent or legal guardian before making a purchase.
We reserve the right to restrict access to our website where reasonably necessary to protect our business, customers or website security.
2. Our Products
The Bark Bakery offers a range of dog treats, including dehydrated meat products, natural chews, baked biscuits and other pet-related products.
We make reasonable efforts to ensure that product descriptions, photographs, ingredients and other information displayed on our website are accurate and up to date.
As many of our products are made from natural ingredients, variations in size, shape, colour, texture and appearance may occur.
These natural variations do not necessarily indicate a product defect. However, nothing in this section affects your rights under Australian Consumer Law if a product fails to meet an applicable consumer guarantee.
Product availability may change without notice, and we reserve the right to discontinue products or reasonably limit purchase quantities.
3. Product Safety and Feeding Guidelines
Our treats are intended for animal consumption only and are not suitable for human consumption.
Customers should select treats appropriate to their dog’s size, age, dietary requirements and chewing habits.
For the safety and wellbeing of your dog, we recommend:
- Supervising your dog while consuming treats and chews.
- Providing access to fresh drinking water.
- Selecting appropriately sized treats and chews.
- Removing any treat or chew that becomes small enough to present a choking risk.
- Following product-specific storage and feeding instructions.
- Consulting a veterinarian if your dog has known allergies, dietary sensitivities or specific health concerns.
Natural treats and chews may present risks, including choking, gastrointestinal upset or dental injury, depending on the individual dog and how the product is consumed.
Our products are intended as treats or supplementary feeding unless expressly identified otherwise.
The information provided on our website is general in nature and is not intended to replace professional veterinary advice.
Nothing in this section excludes or limits our obligations under Australian Consumer Law or any other applicable law.
4. Orders and Acceptance
By placing an order through our website, you are making an offer to purchase the selected products.
An automated order confirmation acknowledges that we have received your order but does not necessarily constitute acceptance.
We reserve the right to decline or cancel an order for legitimate reasons, including product unavailability, payment issues, suspected fraudulent activity or genuine pricing errors, subject to applicable law.
If we cancel an order after payment has been received, we will provide a full refund for the cancelled products and any associated shipping charges paid for an order that will not be fulfilled.
Please review your order carefully before submitting it.
If you need to amend or cancel an order, please contact us as soon as possible. We will endeavour to accommodate requests where the order has not yet been dispatched.
Once an order has been dispatched, cancellation may no longer be possible. This does not affect your statutory consumer rights.
5. Pricing and Payment
All prices displayed on our website are in Australian dollars (AUD) and include Goods and Services Tax (GST) where applicable.
Our advertised prices include any unavoidable fees. Payment processing costs are incorporated into our product pricing, and no additional card payment surcharge is charged at checkout.
Any applicable shipping charges will be clearly displayed before you complete your purchase.
We reserve the right to change product prices, promotions and availability without prior notice. Changes will not retrospectively affect orders that have already been accepted.
Payment must be successfully processed before an order is dispatched.
Payments are processed through the payment providers available at checkout.
You agree to provide accurate billing and payment information and confirm that you are authorised to use your selected payment method.
We reserve the right to correct genuine pricing or listing errors, subject to applicable consumer protection laws.
6. Shipping and Delivery
The Bark Bakery currently ships orders within Australia only.
Shipping options, charges, estimated delivery timeframes and other relevant information are outlined in our Shipping Policy.
We aim to process and dispatch orders within our advertised timeframes.
Delivery estimates are provided as a guide and may be affected by courier delays, public holidays, severe weather or circumstances outside our reasonable control.
We will take reasonable steps to assist customers where an order is delayed, lost or damaged during delivery.
If your order does not arrive, arrives damaged or otherwise fails to meet applicable consumer guarantees, please contact us so we can investigate and provide an appropriate remedy in accordance with Australian Consumer Law.
Nothing in these Terms and Conditions transfers responsibility for goods to customers in a manner inconsistent with applicable law.
Please refer to our Shipping Policy for further information.
7. Returns, Refunds and Exchanges
All purchases are subject to our Refund and Returns Policy, together with your rights under Australian Consumer Law.
Under Australian Consumer Law, customers are entitled to certain remedies where goods fail to meet applicable consumer guarantees.
Depending on the circumstances, these remedies may include a repair, replacement, refund or other appropriate remedy.
For a major failure, customers may be entitled to reject the goods and choose between a refund or replacement, subject to applicable law.
For a minor failure, we may be entitled to provide an appropriate remedy within a reasonable time.
We do not exclude or restrict these statutory rights.
We are not generally required to provide refunds or exchanges for change-of-mind purchases, although any additional change-of-mind arrangements offered by The Bark Bakery will be outlined in our Refund and Returns Policy.
If you receive a product that is damaged, defective, incorrect or otherwise does not meet applicable consumer guarantees, please contact us.
We may request photographs or additional information to help assess the issue, but this does not remove your statutory rights.
Where a product fails to meet an applicable consumer guarantee, we will cover reasonable return costs where required under Australian Consumer Law.
For further details, please refer to our Refund and Returns Policy.

16. Consumer Guarantees and Warranties
Our products come with guarantees that cannot be excluded under Australian Consumer Law.
These guarantees may include requirements that goods be of acceptable quality, fit for any disclosed purpose and consistent with their descriptions.
If a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.
Nothing in these Terms and Conditions excludes, restricts or modifies your rights under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable legislation.
Any additional product information, feeding recommendations or disclaimers provided by The Bark Bakery must be read subject to these statutory protections.
17. Limitation of Liability
To the extent permitted by law, The Bark Bakery is not responsible for losses arising solely from circumstances outside our reasonable control or from a customer’s unlawful or improper use of our website.

- Any remedies available to you under mandatory consumer protection legislation.
Any limitation of liability applies only to the extent permitted by applicable law.

The most current version will be available on our website.
Where required by law, we will provide notice of material changes.
Changes will generally apply from the date they are published or another date specified in the notice.
Changes will not retrospectively remove rights arising under orders already accepted or alter mandatory consumer protections.
22. General Provisions
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure by The Bark Bakery to enforce a provision does not automatically constitute a waiver of its rights.
